Amora Tree Terms of Service
Draft for review, not legal advice, to be reviewed by a qualified Australian lawyer. Version 0.2. Effective date: [effective date].
1. About these terms
These terms are an agreement between you and [Company legal entity / ABN] ("Amora Tree", "we", "us"). They cover your use of amoratree.com and app.amoratree.com.
Our Privacy Policy explains how we handle information. If you're invited to someone else's tree, our Member Terms apply too.
Features marked (coming soon) aren't live yet.
2. Who can use Amora Tree
Amora Tree is available worldwide. You must be 18 or older and able to agree to these terms. You confirm this when you sign up. You need to keep your sign-in details safe. Tell us at [contact email] if you think someone else has used your account.
3. Early access and pricing
Amora Tree is free during early access. Things may change or occasionally break while we build it.
We may introduce paid plans later: [paid plan details]. We'll give you at least [notice period for changes] notice before anything you use starts to cost money. Nothing will be charged without your agreement.
4. Your tree is yours
You own what you add to Amora Tree: your people, stories, sources, photos and notes.
You give us permission to store, process and display your content only so we can run the service for you and the people you share with. This includes making backups, creating exports and showing your content to AI assistants you connect.
This permission ends when your content is deleted, apart from backup copies, which expire as described in our Privacy Policy.
5. Information about other people
Family trees are about real people, so please be thoughtful. You are responsible for what you add, import or ask your AI assistant to add. In particular, you agree to:
- only add information about living people that you have a fair reason to hold, and that you believe is accurate;
- take extra care with sensitive details about living people, such as health, ethnicity, religion or adoption, and with details about children;
- respect the private contact fields, and not share people's contact details outside the tree without a good reason;
- act fairly on any request from a relative to correct, hide or remove their information;
- only upload photos and documents you have the right to use.
Removal requests from relatives. If someone asks us to remove their information, the person is marked Restricted straight away and automatically. They're hidden from members, AI assistants and exports. Once a quick identity check confirms the request, their information is deleted. We'll let you know when this happens. You agree not to re-add someone who has asked to be removed.
We may also limit or remove content that appears to break the law or these terms. Where we can, we'll tell you why.
6. Things you must not do
Please don't use Amora Tree to:
- harass, stalk, shame or harm anyone, or reveal someone's private details to hurt them;
- add content that is unlawful, defamatory or hateful, or that infringes someone else's rights;
- access trees, branches or accounts you aren't allowed to see, or try to get around our security or access limits;
- scrape, overload or reverse-engineer the service, or use it to send spam;
- sell or publish other people's personal information taken from Amora Tree.
7. AI connections (optional)
You can connect your own AI assistant using OAuth/MCP or a personal access token.
- You choose what the AI can see.
- Private contact fields and people you mark "hidden from AI" are never shown to it.
- The AI can only edit your tree if you turn on "Allow changes". Changes can be previewed, confirmed and undone.
- Your AI provider's own terms and privacy policy apply to what you send it. We're not responsible for how they handle it.
- AI can make mistakes, so please check its suggestions.
- Keep your access tokens private. You can revoke them at any time.
8. Import and export
You can import CSV or GEDCOM files, and undo an import.
You can export your whole tree, or export a version "for someone else" with living people reduced and personal details removed.
Once you share an export, it's outside Amora Tree. You're responsible for who you share it with.
9. Sharing and members (coming soon)
You'll be able to invite members and give them roles: co-owner, super admin, branch admin, editor or viewer. Members only see the branch you give them.
As an owner, you're responsible for:
- who you invite;
- what access each person gets;
- removing access when it's no longer appropriate.
Members agree to our Member Terms.
10. Keep your own copy
We take regular backups, but no service is perfect. Please export your tree from time to time and keep your own copy.
11. Third-party services
Amora Tree relies on other services, including:
- place lookup from GeoNames and OpenStreetMap Nominatim;
- hosting on Railway;
- Cloudflare.
Place information comes from these services and may not always be right. Map data is © OpenStreetMap contributors.
12. Ending your use
You can leave at any time by deleting your account in the app. You'll also be able to do this at amoratree.com/delete-account (coming soon).
If you're the only owner of a tree:
- We'll offer you a backup.
- Then we'll delete the tree.
If the tree has co-owners, it stays with them.
We may suspend or close an account if it seriously or repeatedly breaks these terms, puts other people at risk, or if the law requires it. Where it's reasonable, we'll warn you first and give you a chance to export your data.
If we ever shut Amora Tree down, we'll give you at least [notice period for changes] notice so you can export your trees.
13. Our responsibility to you
We'll provide Amora Tree with reasonable care and skill.
Consumer law. Under the Australian Consumer Law, you have rights (consumer guarantees) that can't be excluded. Nothing in these terms limits those rights.
Family-history accuracy. Genealogy relies on records and memories that can be incomplete or wrong. We don't guarantee the accuracy of any tree content, place data or AI output.
Limits on what we're liable for. As far as the law allows:
- we're not liable for content added by users, or for how users or AI providers use information;
- we're not liable for indirect losses, such as lost data you could have backed up, or lost opportunities;
- our total liability to you is limited to the greater of [liability cap] and the fees you paid us in the 12 months before the claim.
Where the law lets us limit our liability for a consumer guarantee, our liability is limited to supplying the service again, or paying the cost of having it supplied again.
Your responsibility. If you break these terms, for example by adding information about someone in a way that breaks the law, you're responsible for the losses this reasonably causes us. This is reduced to the extent that we caused or contributed to the loss.
14. Changes to these terms
We may update these terms as Amora Tree grows. For important changes, we'll tell you at least [notice period for changes] in advance, in the app or by email. If you don't agree, you can export your data and close your account.
15. Disputes and law
If something goes wrong, please contact us first at [contact email] and we'll try to sort it out together.
These terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have jurisdiction.
